Privacy Notice for California Residents

This Privacy Notice applies to the Personal Information of job applicants (“consumers” or “you”) of theSkimm, Inc. (“theSkimm”, “we”, “us” or “our”) that are residents of the state of California (the “CPRA Notice”).  theSkimm will collect, disclose, and otherwise process your personal information for purposes of evaluating your application and related human resources functions, and if a job offer is extended and accepted, for additional employment, benefits administration, health and safety, and other business-related purposes, and in all cases to comply with applicable laws and regulations. If you reside outside the State of California, this CPRA Notice does not apply to you. Capitalized terms not defined in this CPRA Notice shall have the meaning set forth in the CPRA. 

1. Personal Information Collected and Retention Periods

We may collect the personal information categories listed in the tables below. The tables also list, for each category, our expected retention period, or as applicable, the criteria used to determine the retention period.

Personal Information Category

Identifiers, such as your full name, gender, date of birth, signature, home address, telephone numbers, email addresses, and emergency contact information

·       the purposes for which theSkimm processes the personal information (we need to retain the data as long as necessary for such purposes)

·       tax, legal and regulatory obligations and requirements (laws or regulation may set, or recommend, a minimum period for retention of your personal information)

·       generally, we retain the personal information of job applicants for seven (7) years from the last date such applicant was considered for employment 

·        

Protected classification characteristics under California or federal law (and not listed under “sensitive PI” below), such as marital status, age, national origin, ancestry, sex, sexual orientation, sex life, and veteran or military status

·       the purposes for which theSkimm processes the personal information (we need to retain the data as long as necessary for such purposes)

·       tax, legal and regulatory obligations and requirements (laws or regulation may set, or recommend, a minimum period for retention of your personal information)

·       generally, we retain the personal information of job applicants for seven (7) years from the last date such applicant was considered for employment 

Professional or employment-related information, such as your job title, position, hire dates, work history, compensation, performance and disciplinary records, and vacation and sick leave records

theSkimm determines retention period based on the following criteria:

·       the purposes for which theSkimm processes the personal information (we need to retain the data as long as necessary for such purposes)

·       tax, legal and regulatory obligations and requirements (laws or regulation may set, or recommend, a minimum period for retention of your personal information)

·       generally, we retain the personal information of job applicants for seven (7) years from the last date such applicant was considered for employment 

Non-public educational information, such as academic and professional qualifications, educational records, and references

theSkimm determines retention period based on the following criteria:

·       the purposes for which theSkimm processes the personal information (we need to retain the data as long as necessary for such purposes)

·       tax, legal and regulatory obligations and requirements (laws or regulation may set, or recommend, a minimum period for retention of your personal information)

·       generally, we retain the personal information of job applicants for seven (7) years from the last date such applicant was considered for employment 

Information related to immigration status, such as visa information, immigration status, and related documentation

theSkimm determines retention period based on the following criteria:

·       the purposes for which theSkimm processes the personal information (we need to retain the data as long as necessary for such purposes)

·       tax, legal and regulatory obligations and requirements (laws or regulation may set, or recommend, a minimum period for retention of your personal information)

·       generally, we retain the personal information of job applicants for seven (7) years from the last date such applicant was considered for employment

6. Exercising Your Privacy Rights

To exercise the rights described above, please submit a request to us by using the methods outlined below.

To fulfill your request, we may need you to (i) provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative; and (ii) describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it. We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information related to you. 

We will confirm receipt of your request within ten (10) business days of its receipt, and endeavor to respond within forty-five (45) calendar days of its receipt. If we require more time, we will notify you of the extension and provide an explanation of the reason for the extension in writing, and we will provide you with a response no later than ninety (90) calendar days of receipt of the request. The response we provide will also explain the reasons we cannot comply with a request, if applicable. We may charge a reasonable fee to process or respond to your requests if they are excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will inform you of the reasons for this decision and provide you with a cost estimate before completing your request.

 

7. Updates

This CPRA Notice is effective as of the date of the “Last Update” stated under the title of this document. We may change this CPRA Notice from time to time with or without notice to you. By engaging or interacting with us after we make any such changes to this CPRA Notice, you are deemed to have accepted such changes. Please be aware that, to the extent permitted by applicable law, and without prejudice to the foregoing, our use of your personal information is governed by the CPRA  Notice in current effect. Please refer back to this CPRA Notice on a regular basis.
